The County Recorder is required to record all qualified documents submitted by the public. Recorded documents must be the original document and have original signatures. Further, they must contain the tax parcel number and legal description of the property. The document to be recorded is required to be notarized with a notary stamp with a legible notary seal. The fee for recording any document/instrument is $40.00. If the document contains more than 10 legal descriptions, $2.00 will be charged for each additional description.

Documents may also be mailed to the Recorder’s Office for recording. A check for the appropriate fee is required to accompany the document. Please make checks payable to the “Carbon County Recorder’s Office”. Payment must be made at the time of recording. If for any reason an error is detected after recording, the associated fees will not be waived for re-recording and ownership will not change. For more information, please see Utah Code Annotated 17-21-18.5.

• Spacing of 1” inch on left, right and bottom of each page, 2.5″ down and 4.5″ across in the upper right corner of the first page for the Recorder’s Stamp, and 1″ space on the top of each succeeding page.

Utah Code Annotated 17-23-19

Permits counties to establish a Public Land Corner Preservation fund for the establishment, reestablishment, and maintenance of corners of government surveys, and authorizes the county to establish a fee schedule for filing maps in the counties surveyor’s office.

The Carbon County Board of Commissioner does hereby resolve and adopt the following fees for surveys recorded:

Recording Fees for Surveys:

• $5 for survey fund
• $30 for each additional page
• Surveys to be recorded with over ten legal descriptions on the mylar(s) will be charged an additional $2 for each legal description beyond ten.

 

Use of Fees Collected

All of the fees collected for the recording of surveys (exceeding fees in accordance to Utah Code 17-21-18.5) shall be deposited with the Carbon County Treasurer to be credited to the Public Land Corner Preservation Fund for the establishment, reestablishment, and maintenance of corners of government surveys.

What records are available?

• Copies of all recorded documents such as deeds, liens, releases, maps, etc. are available in this office.

What is a tax parcel number?

• A tax parcel number is a number assigned to each piece of property for assessing and taxation purposes.  This number is on your tax notice and on plat maps.  It is used countywide to identify a piece of property.

What is a title search and how do I do it?

• A title search is a record of a piece of property that shows every document recorded on that property since it was patented. If you have a specific document you are looking for, you may access it by doing a title search in our office. Also, if you know the book and page of the document, it can be found online using our various indexes, however it is advised that you consult with a title company if you need a comprehensive search of your property. A title company/or title researcher is licensed and bonded by the state. They can determine the   ownership of a property, any liens or encumbrances, easements or problems that may exist with   the title on the property. Recorder’s Office employees are neither trained nor qualified to do a title search.

What’s the difference between a Quick Claim Deed and a Quit Claim Deed?

• A Quick Claim Deed is simply a mispronunciation of a Quit Claim Deed. In short, a Quit Claim Deed is a deed whereby ownership of real estate is transferred from one party to another.

How do I obtain a copy of my deed or title?

• Title to your property is what is referred to in our office as the deed you received when you purchased your property. A reconveyance is a document recorded to show your mortgage obligation has been satisfied. This is different than the certificate you receive from the Department of Motor Vehicles once your automobile loan is satisfied. Please note, the Recorder’s Office does not keep the original recorded document. They are returned after scanning and indexing. Clear title is NOT determined by the Recorder’s Office. That information is obtained from a title search done by a licensed title company or an attorney. You may request a copy from our office in person or by mail. As per our fee schedule, copies are $1.00 per page. If you would like a copy sent by mail, please enclose the appropriate fee for the copy and a self-addressed stamped envelope.

What is a Warranty Deed?

• The Utah Warranty Deed is a form of deed that provides an unlimited warranty of title. It makes an absolute guarantee that the current owner has good title to the property. The warranty is not limited to the time that the current owner owned the property. This means that the current owner could be legally responsible for title issues that arose before the current owner acquired the property.

How do I change the name on my property?

• A deed must be generated in order to change title on your property. Carbon County is legally bound from giving advice, counsel, or assistance in preparing your deed. If you require help preparing your deed, please contact a title company with the expertise in this area.

Where do I obtain forms for recording?

• The Carbon County Recorder’s office does not carry blank deed forms. Many printing and office supply stores carry these forms. Please note, these documents are legally binding documents, and as such, the Carbon County Recorder’s Office is unauthorized to complete these forms for you.

How do I remove the name of a deceased person on my property?

• In most cases, the estate matter must be probated in District Court. In these cases, often it is best to speak to an attorney or contact a title company to assist in these matters.

How can I find out my property boundaries to put up a fence?

• The Recorder’s Office can provide a plat map of the property, but you may need to contact a surveyor to properly place stakes around the corners of your property if it is not already marked.

What kind of maps are held in the Recorder's Office?

• The Recorder’s Office maintains recorded subdivisions, recorded surveys, and plat maps that show the boundary lines with dimensions and tax parcel numbers.

How do I know if there is a lien on my property?

• You may perform a title search in our office; however, please be aware there may be other liens and judgments affecting your property that will not be found in the Recorder’s Office. You may also contact a title company to perform the search.

How do I remove a lien on my property?

• An attorney will be the best resource for legal counsel regarding filing liens and/or removing a property lien.

How is my property zoned? Can I build on this property?

• Please contact the Carbon County Planning and Zoning Office for information on building and zoning.

How do I find a property owner with an address?

• In most cases, the Recorder’s Office can assist in researching property addresses. Having the tax parcel number is helpful in finding the address. You may also come in to our office so that we may assist you on the interactive GIS mapping system in your search for the address.

When will you return my original recorded document?

• Original recorded documents are generally returned in 5-7 business days.

Can I combine or separate my parcel?

• Parcels can be consolidated or segregated by the owners of record for taxation purposes. The owners’ names on each parcel need to match exactly, and the Carbon County Assessor’s Office must be consulted before any of the above referenced actions can take place. In order to meet the requirements of a legally zoned lot, the owners must contact the Carbon County Planning and Zoning office.

How can I get copies of other recorded records?

• The recorders office provides publicly available land records, if you are looking for a government record that requires approval, visit the GRAMA Requests page to submit a request or contact the County Clerk's office.
